Erin McCarthy, the girlfriend of late billionaire Bruce Wasserstein, has revealed that there are four female embryos, frozen in storage, which belong to her and Wasserstein. Wasserstein died in 2009, but McCarthy had one daughter with him, Sky, who is now 15, and later had a second daughter, Rose, who is now six years old. McCarthy and Sky are currently suing for more than $100 million of Wasserstein’s fortune, with lawyers investigating how to gain legal rights for Rose and the four frozen daughters.
Wasserstein left behind six children, including Rose who was born seven years after his death, and also left behind a widow, two ex-wives, and a mistress. McCarthy claims Wasserstein agreed to raise all of his cryopreserved children with her. The legal battle has raised the possibility of more litigation, with McCarthy exploring whether the four embryos have legal rights and whether they should be transferred and become individuals.
The Legal Battle
McCarthy and Sky’s lawyers are suing Wasserstein’s other children for more than $100 million, with papers filed in New York Surrogate’s Court alleging that Pamela Wasserstein, Sky’s half-sister and president of Vox Media, is a “bully” who has allegedly connived to stop Sky from getting her full inheritance. Sky’s lawyers have accused Pamela of bullying, ostracizing, and neglecting Sky, with Sky’s lawyers stating that Pamela’s behavior makes the behavior of Cinderella’s evil stepsisters seem mild.
Sky’s lawyers are asking for a settlement to be determined at trial for more than $100 million, as well as further damages for her “ostracism,” plus the appointment of an independent trustee of her estate. Sky is already estimated to be sitting on a $170 million inheritance, and she lives with her mother and sister Rose in a Central Park West apartment.
Under the terms of Wasserstein’s trust and estate documents, any child born after his death, such as Rose, would not be a beneficiary. McCarthy signed paperwork agreeing that unused cryopreserved embryos would be discarded in 2027, when she turns 55, but Wasserstein also signed the paperwork agreeing that the embryos “have rights of survivorship” and they would be fully owned by McCarthy in the event of his death.
